This policy explains what we do with your information when you use the Bizzloans website or ask us to compare finance for you. We are bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth), and we handle your information in accordance with them. If anything here is unclear, call us on 1300 617 673 and ask — we would rather explain it than have you guess.
Who we are
Bizzloans Australia is a business finance comparison and referral service. We are operated by GENESIS CHAIN FINANCIAL GROUP PTY LTD, ABN 48 625 098 937.
We are not a lender. We do not lend money and we do not assess or approve applications. Our role is to take what you tell us about your business, match it against the lenders on our panel, and pass your details to the lenders you agree to be referred to. Those lenders each have their own privacy policies, and once your information is with them, their policies govern how they handle it.
What we collect
We collect only what we need to compare finance for you. That usually means:
- Contact details — your name, business email address, phone number, and the state or postcode you trade in.
- Business details — trading and registered business name, ABN or ACN, entity type (company, sole trader, partnership or trust), industry, how long you have been trading, and where the business operates.
- Financial details — turnover, the amount and purpose of the finance you want, existing business debts and repayments, assets offered as security, and, where a lender requires it, bank statements, business activity statements, tax returns or financial statements.
- Credit information — see section 5.
- Website information — your IP address, browser and device type, the pages you visit, and the campaign or referral source that brought you here. Our cookie policy explains this in more detail.
We do not ask for, and do not want, your internet banking passwords. We do not deliberately collect sensitive information as the Privacy Act defines it — health, racial or ethnic origin, political or religious views, and the like. If you send us something like that unprompted, we will not use it, and we will destroy it unless we are required by law to keep it.
Where you give us information about someone else — a co-director, a guarantor, a partner — you must have their permission to do so, and you should show them this policy.
Why we collect it, and what happens if you don't give it to us
We use your information to:
- work out which lenders on our panel are likely to consider your business;
- prepare and submit a referral or application to the lenders you choose;
- answer your questions and keep you updated while a lender assesses you;
- verify your identity and the details you have given us, including checking an ABN against the Australian Business Register;
- improve the site and our service, and understand which of our pages and campaigns are useful;
- send you marketing, subject to section 8; and
- meet our obligations under Australian law, including anti-money laundering and record-keeping requirements.
You do not have to give us your information. You can also deal with us anonymously or under a pseudonym if you only want general information about a product. But if you want us to actually compare finance for you, we need the details above — without them we cannot match you to a lender, and no lender will assess you.
How we collect it
Most of the time we collect information directly from you: through the forms and calculator on this site, by phone, by email, or in person. We also collect it from your accountant or bookkeeper where you have asked them to deal with us.
We may also collect information about you from lenders on our panel (for example, the outcome of an application), from public registers such as the Australian Business Register and ASIC, from credit reporting bodies where section 5 applies, and from referral partners who have your consent to pass your details to us.
Credit information and Part IIIA
Some of what we handle is credit information — things like your credit history, defaults, court judgments and existing credit arrangements. Credit information and credit eligibility information are regulated separately, under Part IIIA of the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code (the CR Code), in addition to the Australian Privacy Principles.
We are a broker.We refer you to lenders on our panel. Any credit check is run by the lender you choose, under that lender’s privacy and credit reporting policies. We do not access credit reporting bodies ourselves and we do not maintain a separate credit reporting policy.
Under Part IIIA and the CR Code you have specific rights, including the right to ask a credit reporting body not to use your information for pre-screening direct marketing, and the right to ask a credit reporting body not to use or disclose your information if you believe you have been or are likely to be a victim of fraud. You can ask a lender for a copy of its credit reporting policy.
Who we disclose it to
We disclose your information to:
- Lenders on our panel — this is the main one, and it is the whole point of the service. We only send your details to lenders you have agreed we can approach, and only so they can assess whether they can help you. We do not send your details to every lender on the panel by default.
- Aggregators, referrers and other brokers — where a lender is only accessible through an aggregator, or where your matter is better handled by a specialist we work with, and you have agreed to that referral.
- Our service providers — the businesses that run our website hosting, customer relationship management, telephony, email, e-signature and analytics tools. They are only permitted to use your information to provide those services to us.
- Your professional advisers — your accountant, bookkeeper or lawyer, where you have asked us to deal with them.
- Courts, regulators and law enforcement — where we are required or authorised by Australian law to disclose it.
We do not sell your personal information and we do not supply it to unrelated third parties for their own marketing.
Overseas disclosure
We store and handle your information in Australia wherever we can. Some of the software we rely on — cloud hosting, email, analytics and customer relationship tools — is supplied by global providers that may store or back up data outside Australia, typically in the United States, the European Union or Singapore.
Before we disclose your information to an overseas recipient we take reasonable steps to ensure they handle it consistently with the Australian Privacy Principles, as APP 8 requires. If you want to know exactly which providers we use and where they hold data, ask us and we will tell you.
Direct marketing and how to opt out
If you have enquired with us, we may send you emails, SMS or calls about business finance products, rate changes and guides we think are relevant to you. We do this under APP 7 and the Spam Act 2003 (Cth).
You can stop it at any time. Use the unsubscribe link in any email, reply STOP to any SMS, tell whoever calls you, or email us at support@bizzloans.com.au. We will action the request promptly and at no cost to you. Opting out of marketing does not stop us contacting you about a finance application that is actually on foot.
You can also ask us to tell you where we got your information from, and we will do so unless it is impracticable or unreasonable to.
We do not use credit eligibility information for direct marketing, and we do not participate in pre-screening for direct marketing purposes.
How we keep it secure
We take reasonable steps to protect your information from misuse, interference, loss, and unauthorised access, modification or disclosure. In practice that means encrypted connections to this website, access controls so that staff only see what they need to do their job, reputable hosting and CRM providers, and secure disposal of records we no longer need.
No system is perfect, and email in particular is not a secure channel. Please do not send us bank statements or identity documents by ordinary email if we have given you a secure upload link instead.
If we ever suffer a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as the Notifiable Data Breaches scheme requires.
How long we keep it
We keep your information only as long as we need it, or as long as the law requires — whichever is longer. As a guide:
- Enquiries that go nowhere — kept for up to 2 years, then deleted or de-identified.
- Applications and settled loans — kept for at least 7 years after the last dealing with you, which is what our record-keeping, tax and anti-money laundering obligations require.
- Marketing contact details — kept until you opt out, plus the minimum period needed to honour that opt-out.
When we no longer need information and no law requires us to keep it, we destroy it or de-identify it. You can ask us to delete what we hold about you and we will, unless we are required to keep it.
Getting access to your information, and correcting it
You can ask us for a copy of the personal information we hold about you, and you can ask us to correct anything that is wrong, out of date, incomplete or misleading. Both rights come from the Australian Privacy Principles, and neither costs you anything to exercise.
To make a request, email support@bizzloans.com.au or call 1300 617 673. Please:
- tell us what information you want, or what you say is wrong; and
- give us enough detail to confirm you are who you say you are — we will not hand personal information to the wrong person.
We will respond within 30 days. If we cannot give you access, or we disagree that something needs correcting, we will tell you why in writing and explain how to complain about that decision. If we have already passed information to a lender and we then correct it, we will tell that lender about the correction where it is reasonable to do so.
Complaints, and how to escalate to the OAIC
If you think we have mishandled your information, tell us first — most things are sorted out quickly once someone actually looks at them.
- Email support@bizzloans.com.au, marked for the Privacy Officer;
- call 1300 617 673; or
- use the complaints option on our contact page.
We will acknowledge your complaint within 5 business days, tell you who is handling it, and give you a written answer within 30 days. If we need longer, we will tell you why and keep you posted.
If you are not satisfied with our answer, you can take it to the Office of the Australian Information Commissioner. The OAIC is the independent regulator for privacy in Australia, and its service is free.
- Online: oaic.gov.au/privacy/privacy-complaints
- Phone: 1300 363 992
- Post: GPO Box 5218, Sydney NSW 2001
For a complaint about credit reporting, you can also complain to the credit reporting body concerned, or to the external dispute resolution scheme the relevant lender belongs to.
Changes to this policy
We may update this policy. The version published on this page is the one that applies, and the date at the top tells you when it last changed. If we make a change that materially affects how we handle your information, we will make that clear rather than quietly swapping the page.
You can ask for a copy of this policy in another format — printed, or plain text — and we will provide it free of charge.
